WASHINGTON (AP) — A federal appeals court docket refused Wednesday to elevate an order barring the Trump administration from deporting Venezuelan migrants to El Salvador below an 18th century wartime legislation.

A break up three-judge panel of the U.S. Court docket of Appeals for the District of Columbia Circuit upheld a March 15 order briefly prohibiting deportations below the Alien Enemies Act of 1798.

Invoking the legislation for the primary time since World Struggle II, President Donald Trump’s administration deported lots of of individuals below a presidential proclamation calling the Tren de Aragua gang an invading drive.

The Justice Division appealed after U.S. District Decide James Boasberg blocked extra deportations and ordered planeloads of Venezuelan immigrants to return to the U.S. That didn’t occur.

Attorneys from the American Civil Liberties Union filed the lawsuit on behalf of 5 Venezuelan noncitizens who had been being held in Texas.
